These terms explain the rules for using NairaCheck, the limits of our market information, and the responsibilities that come with account and verification services.

Agreement to these terms

These Terms & Conditions (the Terms) govern your access to and use of the NairaCheck website, its content, features, tools, application programming interfaces, and related services (together, the Services). In these Terms, “NairaCheck”, “we”, “us”, and “our” refer to the operator of the Services.

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Additional written terms may apply to paid, account-based, API, or verification products. If those additional terms conflict with these Terms, the additional terms control for that product.

Eligibility and authority

You must be at least 18 years old and legally able to enter into a binding agreement to use account-based or business Services. Anyone using the Services for an organisation confirms that they are authorised to bind that organisation to these Terms.

The Services are intended for lawful use. You are responsible for ensuring that your use complies with every law, regulation, professional duty, and contractual obligation that applies to you.

What NairaCheck provides

NairaCheck presents market information and may provide tools relating to exchange rates, commodities, fuel prices, financial information, identity, and account verification. Some features shown on the website are labelled preview, mockup, coming soon, unavailable, or otherwise experimental. Those features are not available for operational use until we expressly launch them.

We may add, change, suspend, or discontinue any part of the Services. We do not promise that a particular feature, source, currency, asset, or verification endpoint will always be available.

Market information and financial disclaimer

Rates, prices, charts, conversions, commentary, and other market information are provided for general information only. They may be delayed, estimated, rounded, incomplete, or different from an executable rate offered by a bank, broker, exchange, merchant, or other provider.

Nothing in the Services is financial, investment, trading, tax, legal, or other professional advice, and nothing is an offer, recommendation, solicitation, or guarantee. Do not rely on NairaCheck alone to enter a transaction or make a financial decision. Check important information with the relevant provider and obtain qualified advice where appropriate. You remain responsible for your decisions and transactions.

Verification services

A verification response is one input into your own review and is not a guarantee of a person’s identity, creditworthiness, authority, conduct, or the absence of fraud. You must apply appropriate human review, risk controls, and legally required due diligence.

If you submit personal data for verification, you must:

  • have a valid lawful basis and provide all notices required by applicable law;
  • submit only data that is relevant, accurate, and necessary for a permitted purpose;
  • honour applicable data-subject rights and retention limits; and
  • not use a result for unlawful discrimination, harassment, surveillance, or harm.

Live verification products may require separate service terms, data-processing terms, documentation, and approved credentials before use.

Accounts and security

When an account or API credential is issued, you must provide accurate information, keep access details confidential, use reasonable security measures, and promptly tell us if you suspect unauthorised access. You are responsible for activity carried out through your account or credentials to the extent permitted by law.

You may not share credentials beyond authorised users, evade usage limits, or conceal the source of requests. We may require you to rotate or disable credentials where reasonably necessary to protect the Services, data subjects, or other users.

Acceptable use

You must not use, or help another person use, the Services to:

  • break the law, infringe rights, commit fraud, or misrepresent identity or authority;
  • gain unauthorised access to any account, system, network, or data;
  • introduce malware, harmful code, or content intended to disrupt the Services;
  • probe or test vulnerabilities without our prior written permission;
  • scrape, copy, or send automated requests in a way that creates unreasonable load, bypasses controls, or breaches applicable source restrictions;
  • reverse engineer or circumvent security, authentication, rate limits, or access restrictions, except where the law expressly permits it; or
  • use personal or verification data for a purpose that is unlawful, unfair, deceptive, or incompatible with the purpose for which it was obtained.

Ownership and permitted use

NairaCheck and its licensors retain all rights in the Services, including the website, software, design, branding, compilation, and original content. Third-party data and marks remain the property of their respective owners and may be subject to separate licence terms.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for their intended lawful purpose under these Terms. No other right is granted. If you send feedback, you allow us to use it without restriction or payment, but you keep ownership of any rights you already hold in it.

Third-party data and links

The Services may display information from, integrate with, or link to independent third parties. We do not control their services, terms, security, accuracy, or privacy practices. A link or reference does not mean that we endorse a third party.

Your use of a third-party service is between you and that provider. Review its terms and privacy notice before providing information or entering a transaction.

Availability and warranties

We aim to provide useful and reliable Services, but internet services and third-party data feeds can fail or change. To the extent permitted by law, the Services are provided “as is” and “as available”. We do not warrant that they will always be secure, uninterrupted, error-free, current, accurate, complete, or fit for a particular purpose.

Nothing in these Terms excludes any warranty, right, or remedy that applicable consumer law says cannot be excluded.

Responsibility and limits of liability

To the extent permitted by law, NairaCheck will not be liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profit, revenue, business, opportunity, goodwill, or data, arising from your use of or inability to use the Services or from reliance on market or verification information.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation, or affects non-waivable statutory consumer rights. Where liability may lawfully be limited, NairaCheck’s aggregate liability will not exceed the amount you paid us for the relevant Service during the 1 month before the event giving rise to the claim, or ₦10,000 if you used it free of charge.

You are responsible for losses and reasonable costs arising from your unlawful use of the Services, your infringement of another person’s rights, or your material breach of these Terms.

Suspension and termination

You may stop using the Services at any time. We may restrict, suspend, or terminate access where we reasonably believe it is necessary to address a breach, security risk, legal requirement, harm to another person, non-payment, or material risk to the Services. Where appropriate, we will try to give notice and an opportunity to remedy the issue.

Provisions that by their nature should continue—including ownership, disclaimers, liability limits, and dispute provisions—survive termination.

Changes to these terms

We may update these Terms to reflect changes to the Services, law, security needs, or business practices. We will post the revised Terms and update the date above. If a change materially affects an account-based or paid Service, we will take reasonable steps to provide additional notice before it takes effect.

Continuing to use the Services after revised Terms take effect means you accept them. If you do not accept a change, you must stop using the affected Services.

Governing law and general terms

These Terms are governed by the laws of the Federal Republic of Nigeria. Before starting formal proceedings, you and NairaCheck will each make a reasonable effort to resolve a dispute in good faith. Subject to any mandatory consumer right or applicable dispute process, Nigerian courts have jurisdiction over disputes relating to these Terms or the Services.

If a provision is found unenforceable, it will be adjusted only as much as necessary and the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver. You may not transfer these Terms without our written consent. These Terms and any applicable product-specific terms form the entire agreement about the Services.
